Do You Need Planning Permission For a Garden Room?

What Are Permitted Development Rights?

Permitted development rights allow homeowners to carry out certain types of development without submitting a full planning application.

Garden rooms are generally classed as outbuildings, provided they meet the relevant criteria. These rules cover factors such as the building’s size, height, position within the garden and intended use.

If your garden room falls within the permitted development rules, you can usually build it without applying for planning permission.

 

Garden Room Planning Permission: What Are the Rules?

There are several important requirements to consider when planning a garden room under permitted development.

1. Where Can a Garden Room Be Built? 

A garden room must generally be located within the curtilage of your house and should be positioned behind the principal elevation of the original dwelling.

There are also restrictions relating to land around the side of a house, particularly where the building would be closer to a boundary.

2. How High Can a Garden Room Be? 

There are specific height restrictions for outbuildings under permitted development.

Where the garden room is within 2 metres of a boundary, the maximum overall height is generally 2.5 metres.

For buildings positioned further from the boundary, different height limits can apply depending on the type of roof.

3. Can I Have a Garden Room Close to a Boundary? 

Yes, a garden room can be positioned close to a boundary, but additional height restrictions may apply.

If any part of the building is within 2 metres of the boundary, the overall height is generally limited to 2.5 metres under permitted development rules.

Your garden room design should therefore take the position of the building and the finished ground levels into account from the outset.

4. Does the Use of My Garden Room Matter? 

Yes. The intended use of a garden room can be an important consideration.

Garden rooms are commonly used as:

  • Home offices
  • Garden gyms
  • Studios
  • Garden bars
  • Games rooms
  • Hobby rooms
  • Garden rooms for relaxation

Using a garden room for purposes that are incidental to the enjoyment of your home is generally treated differently from using it as a separate dwelling or independent living accommodation.

If you are planning a self-contained annexe with facilities such as a kitchen, bathroom and sleeping accommodation, you should seek specific planning advice before proceeding.

5.  Do Garden Rooms Need Planning Permission for a Toilet or Bathroom? 

Adding a toilet or bathroom does not automatically mean that a garden room requires planning permission.

However, the overall use of the building is important. A garden room with a bathroom that remains ancillary to the main house can be treated differently from a building designed and used as an independent dwelling.

Building Regulations and plumbing requirements may also apply, so it is important to consider these separately from planning permission.

What About Conservation Areas & Listed Buildings?

Additional restrictions can apply to properties in conservation areas, World Heritage Sites, National Parks, Areas of Outstanding Natural Beauty and other designated areas.

Listed buildings can also have additional planning and consent requirements.

When Might You Need Planning Permission? 

You may need to make a planning application if your proposed garden room does not meet the permitted development requirements.

This could include situations where:

  • The building exceeds permitted height or size limits.
  • The proposed location does not meet the relevant requirements.
  • The building would be used as a separate self-contained dwelling.
  • Permitted development rights have been removed or restricted.
  • Your property is subject to specific planning restrictions.
  • The property is a listed building or is located in a designated area where additional restrictions apply.
